Wi-Lan wavers after filing appeal in Apple patent dispute

Wi-LAN Inc. (TSE:WIN), a Canadian owner of patents for technology used in mobile phones, fluctuated between gains and losses after saying it has filed  an appeal in a patent dispute with Apple Inc. (NASDAQ:AAPL). 

Shares of the Ottawa-based company were flat at $3.23 at 3:31 p.m. in Toronto. They rose to as high as $3.26 and dropped to as low as $3.20.

Wi-LAN said in a statement today that it has filed the appeal with the U.S. Court of Appeals for the Federal Circuit in its patent dispute with the Cupertino, California–based company involving Wi-LAN's U.S. Patent 802.

On April 3, Judge Rodney Gilstrap of the U.S. District Court for the Eastern District of Texas, ruled that the Jury had no basis for invalidating the 802 patent at the trial of the Wi-LAN vs. Apple lawsuit in October 2013.

"After considering the Court's ruling on April 3, and based on the advice of our counsel McKool Smith, We believe there are strong grounds for an appeal in this case," Wi-LAN Chief Executive Officer Jim Skippen said in the statement.

Wi-LAN is also in litigation with Apple in the Southern District of California concerning the infringement of two patents related to LTE technology. Wi-LAN expects the case in Southern California to go to trial later this year if not settled earlier.
